After having examined the complaints regarding anti-competitive agreements and abuse of dominant position in the port of La Spezia, the Italian Antitrust Authority has deemed that there are no legal and factual elements which may justify further investigations pursuant to Law 287/1990.

The procedure initiated by the Authority in 2015, following the reports of a freight-forwarder from Genova, regarding the alleged violation of competition Law by a concessionaire of services of general interest in the La Spezia Port has been closed.

In granting the application for dismissal, the Antitrust Authority has confirmed that under certain conditions different tariffs may be applied to port users, and that this alone does not amount to a restrictive trade agreement or an abuse of dominant position.

Zunarelli’s team composed of managing partner Massimo Campailla, local partner Gianfranco Borrini and associate Valentina Saviotti have advised the concessionaire in La Spezia.
