Alberto Pasino will be one of the speakers of the 60° UIA Congress which will bring together in Budapest, at the Marriott Budapest Hotel, from 28th October to 1st November, over one thousand lawyers from more than seventy countries.

He will take part in the seminar, organized by the Transport Law Commission on “Direct actions against insurers in transport law litigation”, which will be held on 29th October, starting at 9.00 a.m.. For a party suffering damage from a tort or breach of contract, it may be desirable to sue not only the person liable, but also the liability insurer behind that person. This is a common issue and hot topic in transport law practice, and it is legally challenging. During the seminars the speakers will discuss the concept of direct claims in transport and maritime law from different angles and in different jurisdictions

Mr. Pasino will open the seminar with the presentation “Comparative overview: In which jurisdictions are there possibilities of direct actions and under which conditions? What are possible alternatives?”.

The seminar organized by the Private International Law Commission will take place during the afternoon of the following day on “Recognition and enforcement of foreign judgments and foreign arbitral awards: recent developments”.

Recognition and enforcement of decisions abroad is one of the most critical issues as regards dispute resolution in international matters. When the parties involved are based in different countries, it is essential for the creditor to obtain decisions which are easily and efficiently enforceable in the legal systems where the assets of the debtor are located.

On this subject a crucial point is the lack of uniform international legislation about enforcement procedures, that remain entirely a matter of domestic laws of the country where enforcement is sought. Differences in national systems result in lengthiness of enforcement procedures, additional delays for enforcement or even non-execution of decisions.

During the seminar the speakers will discuss the recent developments worldwide regarding those issues both from domestic and cross-border perspectives, with particular reference to the current trends concerning the principles set forth on this subject in EU Regulations and international Conventions.

Mr. Pasino will open the seminar with the presentation he will hold together with Ms. Monika König of the Law Firm Menold Bezler Rechtsanwälte, on the issue of “Definition of enforceable decision”.
